Terms of Service

INTRODUCTION: Following are some general practices we follow when providing consulting services. Unless we have specifically agreed otherwise with you or your business, these are the conditions under which our services will be provided. If we have provided another agreement, these terms still apply, except for those that have specifically been adjusted to suit your specific needs. In this document, "OLD" shall refer to the business entity "Off Leash Developments, Inc.", a Canadian federal corporation.

RIGHT OF REFUSAL: OLD reserves the right to refuse the sale of software or consulting services to anyone. OLD also reserves the right to require a specific set of terms for individual consulting projects, as the case may warrant (at the discretion of OLD).

Some software titles ("restricted titles") may be restricted for export only to particular countries. OLD strives to conform to local laws and regulations concerning the export of such restricted titles, including restricting their download or purchase to locations where they may be legally exported.

CHANGE OF POLICY: This policy is subject to change at any time.

RATES: Our standard consulting rates (by appointment) are $100 CAD per hour of labor, billed in 15 minute increments. Unscheduled/emergency visits are billed at 125% of the standard rate. We are happy to provide special rates for educational institutions, large volumes of labor, or flat rates for whole projects. Such rates are negotiated on a case-by-case basis, either by verbal or written contract (at the discretion of OLD).

WARRANTY: Off Leash Developments takes pride in providing the best service possible. All custom software is covered by a 90 day warranty. This means that we will warranty that our software will work as agreed for 90 days following deployment (the "warranty period"), provided no modifications to server hardware or software are made outside of OLD’s control. During the warranty period, OLD will provide deployment support upon customer request to ensure that the deployed software works as intended. Service Level Agreements ("SLA") are not implicitly provided; OLD provides no guarantee for support turnaround time during the warranty period, but if desired by the customer, an SLA may be negotiated on a case-by-case basis.

Shareware software titles are generally sold "as is", but are subject to the conditions of the End User License Agreement ("EULA") bundled with the particular title.

PAYMENT & REFUNDS: As services, milestones, or projects are completed, an invoice will be issued by OLD indicating the service(s) provided and associated amount due. An invoice is due as of the date indicated on the invoice. Following the due date, you incur a 5% per month late payment fee, compounded on the original amount. Once payment has been tendered, all services are non-refundable.

All shareware software sales are final.
